Eminent Domain

Description

Eminent domain is the inherent power of the State to take private property for public use upon payment of just compensation.


Purpose 

Eminent domain permits the State to take private property for public use, subject to the payment of just compensation. It balances public necessity with private ownership by ensuring that takings are neither arbitrary nor confiscatory.
