Equal Protection

Description

Equal protection of the laws is the constitutional guarantee that persons similarly situated must be treated alike, and that classifications affecting rights must rest on real and substantial distinctions relevant to a legitimate governmental purpose.

Purpose

Equal Protection ensures that similarly situated persons are treated alike under the law and that distinctions made by the State are justified. It guards against discrimination and reinforces the idea that laws must serve legitimate public purposes, not prejudice or favoritism.

Main points

  • Equality is relational, not absolute

  • Classifications require justification

  • Arbitrariness is constitutionally prohibited
